Congratulations to Russ Schell for his Defense Verdict in the Parra-Lopez Case.

Russ represented an interventional radiologist who performed a kidney biopsy on Plaintiff’s brother, Jesus Parra-Lopez. The procedure went according to plan and Mr. Parra-Lopez recovered from anesthesia as expected. He was given the follow-up and post-operative instructions and discharged home. He was advised to return to the hospital if he exhibited any signs of bleeding, infection, or unexpected pain. He was educated on what to look for and executed the documents acknowledging he understood. Several hours after he returned home, the patient began experiencing abnormal pain and displaying signs of potential bleeding; however, he did not return to the hospital. Ultimately, the patient died of hemorrhage. Russ put on evidence that this is a known risk of the procedure, even under the best of care, and unfortunately, the patient did not adhere to the warnings provided. Russ also elicited testimony that his client’s medical technique was appropriate, and the patient had no indications of bleeding prior to discharge. The jury returned its verdict in Russ’s client’s favor after a very short deliberation.
