Congratulations to Russ Schell for His Defense Verdict in the Galloway Case

This matter was brought by Jackie Galloway, a former Olympic athlete who had taken vitamin supplements manufactured by Russ’s client. After beginning her use of the supplements, the Plaintiff tested positive for banned substances with the Olympic Committee. Plaintiff alleged the manufacturer allowed for cross-contamination, which resulted in her testing positive for the banned substance. At trial, Russ successfully put on evidence to show that the manufacturer had never used or manufactured the banned substance; no other pills or bottles tested from the same lot tested positive for the banned substance; and Plaintiff’s boyfriend testified that he and Plaintiff often shared supplements. Plaintiff was claiming over a million dollars in damages because the failed drug test prevented her from competing in the 2020 Olympics and tarnished her record.
