Congratulations to Russ Schell and Casey Campbell for their defense verdict in the Echols case. This matter involved a plaintiff who presented to the emergency department complaining of being shot in the head. After a physical exam and closing the wound, the patient was discharged home without any imaging being ordered or performed. Five days later, the patient presented to another emergency department with complaints of headache and difficulty sleeping. Imaging was performed and a depressed skull fracture with a bullet fragment was identified. The patient underwent surgery to remove the bullet and repair the skull. He subsequently complained of seizures, neurologic deficits, and cognitive impairment, and sought more than $3,000,000 in damages. After six days of trial, the jury returned a verdict in favor of our physician client.
